§ 2.1. Sidewalk improvement districts.

The Council may construct, reconstruct, or repair any sidewalk, driveway return, or curb in the city when the public necessity requires such improvements. No change of grade previously established by the city shall be made without the payment of compensation to the owner of abutting property for any damage caused to permanent improvements erected with reference to the established grade; provided, the failure to pay such compensation shall not prevent the construction, repair, or improvement of sidewalks, driveway returns, or curbs, or invalidate any assessment against the property for the cost of such construction, reconstruction, or repair.
