§ 101. Definitions.

  • Unless otherwise provided herein, for the purposes of this title and any rules or regulations adopted pursuant to its provisions, the following terms shall have the meanings given herein.

    Acceptable solid waste shall mean solid waste which is not unacceptable waste and which is collected within the City of Tulsa.

    Authority shall mean the Tulsa Authority for the Recovery of Energy, an Oklahoma public trust, and shall include the Tulsa Authority for the Recovery of Energy's appointed officials, officers, employees, and agents.

    Backyard collection service shall mean collection of all residential solid waste and program recyclable materials at the following location:

    A.

    A location at the front, side or rear of a residential service unit;

    B.

    A location greater than four (4) feet but not in excess of one hundred (100) feet from the curb of such residential service unit or traveled portion of any roadway;

    C.

    A location acceptable to both the resident and contractor for collection of residential solid waste and program recyclable materials; and

    D.

    Bulky waste and/or curbside yard waste are not collected from a backyard location.

    Bag shall mean a container of flexible material designed or intended to store acceptable solid waste with sufficient wall strength to maintain physical integrity when lifted at the top. Bags placed outside of the cart shall not exceed forty (40) pounds in weight. All bags must be closed or sealed.

    Bulky waste shall mean acceptable solid waste composed of materials not easily fitting into a cart such as, but not limited to, green waste, furniture, large electronics, and large appliances. Bulky waste includes:

    A.

    Items such as appliances including washers, dryers or stoves; furniture including couches, recliners, mattresses, or box springs; other large household items including pianos, grills, televisions and computers.

    B.

    Residential solid waste in a bag but without an extra refuse sticker.

    C.

    Bags or bundles of curbside yard waste.

    D.

    Tree limbs and brush that are larger in size than curbside yard waste.

    E.

    Refrigerators, freezers, dehumidifiers, air-conditioning units and other appliances which contain chlorofluorocarbons (CFCs) or hydrochlorofluorocarbons (HCFCs).

    As respects green waste, the term "bulky waste" shall include tree stumps having a diameter at two (2) feet or more.

    Cart shall mean a receptacle provided by the authority, equipped with wheels, a bar, and a radio frequency identification (RFID) tag (UHF), with a capacity of approximately ninety-six (96) gallons, sixty-four (64) gallons, forty-eight (48) gallons or thirty-two (32) gallons, designed to be dumped into a loader-packer type truck.

    City shall mean the City of Tulsa, Oklahoma in its capacity as a duly constituted and organized municipality under and pursuant to its Charter and the laws of the State and shall include City's officers, elected officials, employees and agents.

    Collections contractor shall mean a person contracted by the authority to collect residential solid waste, program recyclable materials and/or curbside yard waste.

    Commercial establishment shall mean an establishment which is not a residential service unit where the operation or establishment may be characterized as commercial, industrial or institutional in nature. Commercial establishments include mobile home parks and other multifamily structures or complexes having four (4) or more units where the solid waste collection container or containers are used jointly by the occupants of such structures so that no single occupant has exclusive use thereof and/or where no individual family unit within the multifamily structure or complex is serviced or billed directly through an individual water meter.

    Commercial solid waste shall mean all solid waste resulting from any operation or generated within or emanating from any commercial establishment.

    Commercial waste container shall mean any receptacle from which or in which commercial solid waste is collected by commercial waste collectors.

    Construction and demolition waste shall mean wastes from construction and demolition operations and shall include, but shall not be limited to concrete, bricks, plumbing fixtures, plastics, lumber, trees and tree trimmings.

    Contract administrator shall mean the City's refuse and recycling systems manager, or designee, or such other person(s) designated by the authority, which shall represent the authority in the administration and supervision of the authority's agreements with its vendors, contractors and suppliers.

    Curb shall mean the edge of a traversable roadway marked or understood as such.

    Curbside shall mean a location within four (4) feet of the curb or traveled portion of any roadway and outside any fence.

    Curbside collection service shall mean collection at curbside of all residential solid waste, program recyclable materials, curbside yard waste and bulky waste.

    Curbside yard waste shall mean grass clippings, vegetation trimmings, leaves, branches and limbs collected from residential service units and placed in clear bags or tied in bundles placed curbside for collection. Bags or bundles shall not exceed forty (40) pounds in weight per item and tied bundles shall not exceed four (4) feet in length and two (2) feet in diameter.

    Director shall mean the director of the streets and stormwater department of the city.

    Disposal site shall mean the location where any final treatment, utilization, processing or developing of solid waste occurs, but does not include incineration.

    Extended backyard collection service shall mean collection of all residential solid waste and program recyclable materials at the following location:

    A.

    A location at the front, side or rear of a residential service unit;

    B.

    A location greater than one hundred (100) feet from the curb of such residential service unit or traveled portion of any roadway;

    C.

    A location acceptable to both the resident and collections contractor for collection of residential solid waste and program recyclable materials; and

    D.

    Bulky waste and/or curbside yard waste are not collected from an extended backyard location.

    Extra acceptable solid waste shall mean residential solid waste exceeding the quantity that can be contained in solid waste cart(s) at the residential service unit which must be placed in bags with an extra refuse sticker affixed.

    Extra refuse sticker shall mean a self-adhesive sticker purchased from the city, the authority, or authorized agents which must be affixed to all bags outside the cart which contain extra acceptable solid waste.

    Garbage shall mean all putrescible wastes from any place where meats, fish, fowl, fruits or vegetables are prepared for food for immediate consumption and shall include all household waste containing organic matter that has been prepared for or was intended to be used as food or has resulted from the preparation of food. Garbage shall include cigarette butts, ashes, dead animals, animal excreta or any article or substances soiled by human or animal excreta or any other bodily fluid.

    Green waste shall mean burnable debris as defined by the Federal Emergency Management Agency, including, but not limited to, grass clippings; leaves; damaged and disturbed trees, bushes and shrubs; broken, partially broken, and severed tree limbs, processed or unprocessed; tree stumps (limited to those less than two (2) feet in diameter), and bushes. Burnable debris consists predominately of trees and vegetation.

    Green waste disposal site shall mean any City-operated land reclamation site(s).

    Hazardous waste shall have the meaning set forth in 27A O.S. § 2-7-103, as amended from time to time.

    Health department shall mean the Tulsa City-County Health Department, sometimes referred to as the "Tulsa Health Department;" should it cease to exist, the term shall mean the Oklahoma State Department of Health or any other governmental agency having jurisdiction over public health in the City of Tulsa.

    Household pollutants shall mean residential solid waste that consists of substances and materials that are identified as "household hazardous waste" as defined in the regulations of the Oklahoma Department of Environmental Quality at Section 252:515-1-2 of the Oklahoma Administrative Code.

    Once per week collection service shall mean collection of residential solid waste, program recyclable materials, and curbside yard waste once per week at a residential service unit.

    Person shall mean any individual, firm, corporation, organization, government or governmental subdivision or agency, business trust, partnership, association, or any other legal entity, where appropriate in the context.

    Physically limited services shall mean once per week backyard collection service or extended backyard collection service at any residence where the person responsible for the payment of the utility services and every person residing at the residence suffers from certain infirmities of health, or physical limitations which make them unable to place their residential solid waste and program recyclable materials at the curb as certified by a licensed physician or, if appropriate, a doctor of optometry.

    Program recyclable materials shall mean materials determined by the authority to be accepted for collection as recyclable material to be collected in the city's voluntary residential recycling program and processed for recycling pursuant to this title. A current list of program recyclable materials is published by the City and available online at http://www.tulsarecycles.com.

    Recyclable material shall mean material that has reached the end of its useful life which can be processed into material utilized in the production of new products.

    Recycling shall mean a series of activities by which material that has reached the end of its useful life is processed into materials utilized in the production of new products.

    Residential service unit shall mean the following occupied dwellings within the City of Tulsa:

    A.

    Single family houses;

    B.

    Duplexes;

    C.

    Triplexes; and

    D.

    Other residential establishments utilizing carts for collection of residential solid waste and designated as a residential service unit by the contract administrator.

    A residential service unit shall be deemed occupied when either water or domestic light and power services are being supplied thereto.

    Residential services shall mean collection of residential solid waste, program recyclable materials, curbside yard waste, and bulky waste from residential service units.

    Residential solid waste shall mean all acceptable solid waste resulting from any operation or generated within or from any residential service unit.

    Roadway shall mean that portion of a street improved, designed and ordinarily used for vehicular travel.

    Solid waste shall mean all putrescible and non-putrescible refuse in solid, semisolid, or liquid form including, but not limited to, garbage, rubbish, ashes or incinerator residue, street refuse, dead animals, construction and demolition waste, solid or semisolid commercial and industrial wastes including explosives, biomedical wastes, chemical wastes, herbicide and pesticide wastes. The term "solid waste" shall not include:

    A.

    Scrap materials which are source separated for collection and processing as industrial raw materials, except when contained in the waste collected by or on behalf of a solid waste management system;

    B.

    Used motor oil, which shall not be considered to be a solid waste but shall be considered a deleterious substance.

    State shall mean the State of Oklahoma.

    Twice per week collection service shall mean once per week collection service plus one additional residential solid waste collection per week.

    Unacceptable waste shall mean disaster debris; hazardous waste; construction and demolition waste; poisons; acids; caustics; explosives; medical wastes; body wastes; bio-hazardous wastes; automobile frames; petroleum products and materials which may cause damage to collection equipment or personal injury to collectors; animal excreta or any article or substances soiled by human or animal excreta that has not been tightly sealed in a plastic bag prior to placement for collection; refuse which has been combined or mixed with any of the above-mentioned items; and any materials which would have a reasonable possibility of causing injury to health, safety, or property, which is collected from residential service units.
