§ 203. Preparation of residential solid waste for collection.

  • A.

    Except as provided in subsection (B), residential solid waste shall be placed for collection only in carts provided by the authority and in a manner that does not impede the free flow of materials from the cart when it is being emptied. In order to keep carts clean, substantially all residential solid waste shall be contained in bags as defined in Chapter 1 of this title. Residential solid waste placed for collection at a residential service unit shall consist only of residential solid waste generated at the location of such residential service unit.

    B.

    Residential solid waste may be placed outside of a cart for collection only under the following circumstances:

    1.

    Residential solid waste must be contained in a bag and the bag must be securely tied.

    2.

    The bag and contents of the bag weigh no more than forty (40) pounds.

    3.

    Adhered to the bag is an extra refuse sticker issued by the authority.

    4.

    A maximum of fifteen (15) items placed outside the cart(s) shall be set out for collection each week. The collection limit applies to any combination of bags affixed with an extra refuse sticker, clear bags containing curbside yard waste and/or bundles of curbside yard waste.

    C.

    Materials which would have a reasonable possibility of causing injury to the health, safety or property of the collectors or others such as broken glass, hypodermic needles, sawdust, animal excrement, shall only be placed for collection as permitted by, and prepared in accordance with, the standards set forth in the rules and regulations adopted pursuant to the provisions of this title.

    D.

    All containers of liquids and all residential solid waste that is mixed with liquids shall be drained before being placed in carts for collection.
