§ 403. Commercial waste containers required.

  • Every owner, occupant or tenant occupying or using any commercial establishment shall utilize commercial waste containers of sufficient number and size to hold the solid waste that accumulates at the commercial establishment between regular collection days. Commercial waste containers shall be leakproof, constructed of substantial material, have a tight-fitting lid or cover, and be maintained in good condition. If stored outdoors, they shall also be weatherproof.

    Commercial waste containers shall be kept secure with lids closed or covers in place when stored or placed for collection to prevent access to their contents by insects, rodents, and other animals, to minimize fire hazard, and to prevent accumulation of water and scattering of litter. When containers deteriorate so as to become non-leakproof or otherwise hazardous to persons or property, they shall be replaced.
