§ 1221. Thermal service row usage fee.

All providers of thermal service shall pay a thermal service ROW usage fee in the amount of three percent (3%) of the gross revenues from the sale of chilled water and steam. The thermal service ROW usage fee shall be in addition to the occupancy fee. The thermal service ROW usage fee shall be payable monthly on or before the 25th day of each month, on the cash receipts of the preceding calendar month. If the monthly payment is not timely made, interest upon any unpaid portion shall accrue at the rate of one and one-half percent (1.5%) per month until paid. Those providing thermal service shall furnish with each monthly payment a complete and accurate, verified statement of all gross revenues from sales within the City of Tulsa during the month for which said payment is made. Such statement and payment shall be made to the Director of Finance. If the provider of thermal service fails or refuses to pay such fee, the City may maintain an action against the thermal service provider for the amount of such fee and interest and all expenses of collecting same, including reasonable attorneys' fees. The fee and interest imposed hereunder shall constitute a first and prior lien upon all of the assets of the thermal service provider located within the City of Tulsa, Oklahoma.
