§ 1715. Penalty.

A.

Any person who shall violate any of the provisions of this chapter, either by doing anything which is prohibited or by failure or refusal to do anything which is commanded, shall be guilty of an offense and, upon conviction thereof, shall be punished by a fine of not more than Five Hundred Dollars ($500.00), excluding costs, and/or by imprisonment in the City jail for a period not exceeding ninety (90) days. Each day that a violation is committed or permitted to continue shall constitute a separate offense.

B.

A person who operates or causes to be operated a sexually oriented business without a valid license or in violation of this chapter, is subject to a suit for injunction as well as prosecution for criminal violations.
