§ 309. Prohibition of nudity or sexual acts.

It shall be unlawful for any person to do or permit to be done any of the following acts on or about the premises of any establishment licensed pursuant to the provisions of the Oklahoma Alcoholic Beverage Control Act:

A.

Any acts, or simulated acts of sexual intercourse, masturbation, sodomy, bestiality, oral copulation, flagellation or any sexual acts which are prohibited by law;

B.

The actual or simulated touching, caressing or fondling of the breasts, buttocks, anus or genitals;

C.

The actual or simulated displaying of the pubic hair, anus, vulva or genitals;

D.

The permitting by a licensee of any person to remain in or upon the licensed premises who exposes to public view any portion of his or her genitals or anus;

E.

The actual or simulated exposure, exhibition, display or revelation, either continually or intermittently, of the nipple or the pigmented portion adjacent thereto, otherwise defined as the areola, of any female person, including but not limited to the wearing of any costume or garment which by virtue of construction or transparency of the material permits such exposure; or

F.

The displaying of films or pictures depicting acts, a live performance of which is prohibited by this section.
