Chapter 3. DETENTION FACILITIES AND RECREATIONAL AREAS SUPERVISED BY PUBLIC WORKS |
§ 303. Prohibited acts.
A.
No person shall mark, deface, disfigure, tamper with or displace or remove any buildings, bridges, tables, benches, fireplaces, decorative structures, railings, pavings or paving materials, water lines or other public utilities or parts or appurtenances thereof, signs, notices or place cards, whether temporary or permanent, monuments, stakes, posts or other boundary markers, other structures or equipment, facilities or property or appurtenances whatsoever, either real or personal.
B.
No person shall damage, cut, carve, mark, transplant or remove any plant or injure the bark; pick flowers or seed of any tree or plant; dig in or otherwise disturb grass areas; or in any other way injure the natural beauty or usefulness of any area.
C.
No person shall cut any tree, dead or alive, whether erect or felled, or collect leaves, bark, wood chips, mulch, or other organic material, or soil for any purpose without the written permission of the Director.
D.
No person shall handle or disturb plants or flowers or any other object or thing in any conservatory, greenhouse, propagating house or nursery; or remove any flowers, either cut or uncut, or plants or property of any facility, propagating area or greenhouse; or plant, set out or otherwise place any plant material, tree, shrub or flower within any facility without the written permission of the Director.
E.
No person shall hunt, molest, harm, frighten, kill, trap, pursue, chase, tease, shoot or throw missiles at any animal, wildlife, reptile or bird or give or attempt to give any such animal any noxious substance or anything disagreeable to any such animal, or have in one's possession any wild animal or its young, or the eggs, nest or young of any bird or reptile. Any person convicted of violating any of the provisions of this subsection shall be guilty of an offense and, upon conviction thereof, shall be punished by a fine of not more than Five Hundred Dollars ($500.00), excluding costs, and imprisonment in the City jail for a period of not less than ten (10) days nor more than ninety (90) days.
F.
No person shall skate, glide or coast by means of ice skates, shoe or snowmobile in any facility except those that may be designated for such use by the Director.
G.
No person shall discharge or otherwise place or cause to be placed in the waters of any fountain, pond, lake, stream or other body of water in or adjacent to any facility, or in any stream, storm sewer or drain flowing into such facility any substance, matter, thing, liquid or solid which will or may result in the pollution of the waters.
H.
No person shall start the water flowing from any water supply or spigot, other than at a drinking fountain or place provided as a watering place for people or animals, or disregard or fail to comply with any rule or regulation posted or displayed at any swimming pool, wading pool or bathing beach.
I.
No person shall make a fire in any facility except in places provided for such purposes. Any fire shall be under the continuous care and supervision of a competent person from the time it is kindled until it is extinguished. No person shall throw away or discard any lighted match, cigar, cigarette, tobacco, paper or other material or ignite or set off any fireworks, model rockets or other incendiary device in any facility.
J.
No person shall ride, drive or allow a horse in any facility, except for those trails or facilities specifically designated for equestrian use. At no time shall any horse be left unattended or be fastened to anything other than a post or rail specifically provided and designated for such use.
K.
No person shall use any portion of any facility for toilet purposes, except the public restrooms or comfort stations provided.
L.
No person shall seine for minnows or other aquatic animals or use a seine for any purpose within any body of water in any facility. No person shall catch or take or attempt to catch or take in any manner within any facility any fish for commercial purposes, except that this shall not apply to anyone acting pursuant to a valid contract for the taking of rough fish. Bow fishing is prohibited in all facilities unless such area is specifically designated and posted for such activity.
M.
No person shall offer or expose for sale for a profit any article without first having obtained a concessionaire's license.
N.
No person shall enter upon or use any facility without paying an admission, rental or membership fee when such fee has been established or has been approved by the Director by contract. No person shall enter into any facility by other than the approved means of access or remove or disturb any barrier intended to prevent access, entry or occupancy. No person shall go into any shrubbery or enclosure or upon any lawn, slope or other area where there is a sign prohibiting such ingress.
O.
No person shall drive upon or park in any facility, except upon a parkway or parking lot. No vehicle shall be operated at a speed in excess of twenty-five (25) miles per hour. Under no circumstances shall any vehicle designed for the purpose of transporting freight, merchandise or bulk materials of any kind, enter into any facility.
P.
No person shall disregard any rule or regulation promulgated by the Director, including rules of conduct, covering the use of any facility.
Q.
No person shall bring into or have in his possession in any facility any BB gun, air pistol, bow and arrow, crossbow, slingshot, knife or other weapon capable of inflicting injury to persons, animals or public property, whether or not such weapons are loaded, unless such facility has been specifically designated and posted for such use or unless the use is in conjunction with an approved program; except this section shall not prohibit and is not intended to regulate or touch in any way pistols, rifles or other firearms, their components, ammunition or supplies, in deference to the state of Oklahoma's preemption of this subject matter pursuant to Title 21, Oklahoma Statutes, Section 1289.24, and the state of Oklahoma's regulation and prohibitions applicable to the possession, carrying or bearing of firearms, whether concealed or unconcealed, in Title 21, Oklahoma Statutes, Chapter 53, Sections 1271, et seq., including the Oklahoma Self Defense Act.
R.
No person shall swim or wade in any lagoon, lake, fountain or other waters in any facility, without the written consent of the Director, except in swimming, wading or spray pools constructed for such activities or areas specifically designated for such activities. Further, no person shall swim or wade in any pool at any time when the pool is not open to the public.
S.
No person shall disturb any tree in any park area or facility. For purposes of this subsection, disturbing shall include but not be limited to clubbing, flailing, thrashing, shaking, throwing objects into, ramming, shooting or climbing into any tree. Any person convicted of violating any of the provisions of this subsection shall be guilty of an offense and, upon conviction thereof, shall be punished by a fine of not more than Five Hundred Dollars ($500.00), excluding costs, and imprisonment in the City jail for a period of not less than five (5) days nor more than ninety (90) days.
T.
No person shall interfere with, disobey or ignore any lawful order of an employee while in the performance of his duties in any facility.
U.
No person shall attach any rope, cable or other contrivance, or post, paint, erect or place any sign, banner or advertisement to any tree, fence, railing, bridge, bench or other structure.
V.
No person shall consume any beverage containing alcohol on a road or parking lot within any facility.
W.
No person shall practice golf in any facility not specifically designated for such uses.
X.
No person shall camp, erect a tent, build a fire or park an automobile or other vehicle for the purpose of sleeping therein or under cover projecting therefrom within any facility other than those designated and set aside for such purposes.
