§ 2805. Enforcement.

  • Before taking any enforcement action under this chapter, a police officer shall ask the apparent offender's age and reason for being in the public place. The officer shall not issue a citation or make an arrest under this chapter unless the officer reasonably believes that an offense has occurred and that based on any response and other circumstances, no defense in Section 2804 is present.

    Absent an interlocal agreement with the District Court for the Municipal Court to exercise jurisdiction over juveniles under 18 years of age under Section 2802 pursuant to 10 O.S.Supp.1996, § 7303-1.2, the Municipal Court must refer all alleged juvenile violations to the Juvenile Bureau of the District Attorney's Office.
