§ 128. Return of passenger's property.

  • A.

    Upon finding property left by a passenger in a taxicab, paratransit vehicle, or utility vehicle for hire, the chauffeur shall immediately notify the passenger and return the property. If the chauffeur is unable to locate or does not know the identity of the passenger, the chauffeur shall promptly deliver the property to his holder.

    B.

    Upon delivery of the property to the holder, the chauffeur shall prepare and deliver to the holder a written report containing the description of the property, the identity of the passenger, if known, the date the property was left in the vehicle, the circumstances relating to the loss and the vehicle number. The holder shall keep the record on file for a period of one (1) year. The holder shall retain the property for a period of not less than three (3) months.

    C.

    Any request for the return of the property by the chauffeur who discovered it must be made to the holder during the thirty (30) days following the three-month holding period, referenced in paragraph B. The holder need not honor the chauffeur's request if made beyond this time frame.

    D.

    If either the holder or the chauffeur chooses to dispose of the property, said disposition must be in compliance with applicable state law regarding lost goods.
