§ 144. Physically limited transport service.

  • A.

    It is the purpose of this section to provide for a specialized transportation service to meet the needs of the elderly, the physically limited or persons requiring special attention but not requiring medical assistance, stretcher transportation or emergency services.

    B.

    In addition to all the other requirements of this chapter, a holder or chauffeur operating a physically limited transport vehicle shall comply with the special requirements given herein. It shall be unlawful for a person or holder operating a physically limited transport vehicle knowingly to:

    1.

    Respond to a call where emergency medical services or ambulance transportation is medically necessary;

    2.

    Respond to a call for the transportation of a person requiring a stretcher;

    3.

    Respond to a call where a passenger's condition is such that the use of an ambulance is indicated;

    4.

    Respond to a call for an emergency transfer to a hospital;

    5.

    Respond to a call for transportation of a passenger who can be moved to and from the transport vehicle only by a stretcher or in a horizontal position; or

    6.

    Respond to a call for the transportation of a person who under normal circumstances could utilize the services of a standard taxicab company.

    C.

    The holder shall, upon receipt of a call for service, make inquiry about whether the call is for emergency, medical or stretcher transportation and if so, the holder shall immediately call for an ambulance licensed under the Revised Ordinances of the City of Tulsa.

    D.

    The holder is authorized to make available to its passengers incidental services as may be requested by a passenger.

    E.

    The holder shall comply with the requirements of Section 111 of this chapter with the following increased limits: a comprehensive automobile liability insurance covering each owned, hired and non-owned vehicle in the amount of Three Hundred Thousand Dollars ($300,000.00) combined single limits.

    F.

    A holder, under this section, may also transport persons confined to wheelchairs if the vehicle is licensed under Section 143 of this chapter.

    G.

    Any trade name to be used by a holder under this section shall be submitted to the Director for approval prior to its use.

    H.

    It shall be unlawful for a holder to use the terms "ambulance," "non-emergency vehicle," "medical transport" or any other term or name which implies or infers that he is providing medical, stretcher or emergency service.

    I.

    A chauffeur of a physically limited transport vehicle shall provide door-through-door escort assistance to all passengers of the service.
