§ 414. Sole source and sole brand acquisitions.

    Sole Source.

    1.

    Criteria. The Mayor may waive the requirement for a competitive process for the purchase of supplies or services when some material feature or characteristic of the supply or service sought to be purchased is unique and the Agent has certified that to the best of his knowledge, after diligent inquiry, the supply or service is available from only one (1) source. The Agent may also waive this requirement for a competitive process but only where the expected cost for the supply or service is less than Twenty-Five Thousand Dollars ($25,000.00).

    Procedure. The Agent may require the department head or official requesting the bid waiver to submit an affidavit identifying the unique and material features or characteristics of the supply or service. A full and complete statement of the reasons for approving each waiver of the competitive process shall be filed with the City Clerk.

    B.

    Sole Brand.

    1.

    Criteria. Where some material feature of one (1) manufacturer, or brand, of supply or service is unique, but the supply or service is available from more than one (1) supplier, a sole brand competitive process limiting bids to that manufacturer, or brand, can be approved.

    2.

    Procedure. The Agent may require the department head or official requesting the sole brand to submit an affidavit identifying the unique and material features or characteristics of the brand, or manufacturer, of the supply or service. A competitive process which limits, by specification, acceptable bids to one (1) manufacturer or brand of item, shall be used. Except as provided herein, the requirements for competitive processes set forth in Section 407 shall apply.
