This chapter applies, to the greatest extent permissible under applicable law, to
all ROW occupants. If, on the effective date of this chapter, a person holds a franchise,
or has prior rights under a contract, and the terms of this chapter conflict with
or impose additional requirements or obligations not contained in the franchise or
contract, that person is exempted from such terms of this chapter and the terms of
the franchise shall control, to the extent required by the franchise or contract and
applicable law.
