§ 301. Grant of Franchise.

A.

The City hereby grants to Grantee, Oklahoma Natural Gas Company, a division of ONEOK Inc., a corporation, for the term of fifteen (15) years from the passage of this Ordinance and the filing of a written acceptance by the Grantee, the right to enter upon the rights-of-way to install, operate and maintain a distribution system along, across, over and under the rights-of-way for the privilege of transporting, distributing and selling natural gas to consumers and the public generally within the corporate limits of the City of Tulsa.

B.

No main natural gas line shall be laid in any park without special permission, designating the location of such line, from the City.

C.

This Ordinance shall have the effect of and shall be a contract between City and Grantee and shall be the measure of the rights and liabilities of the City as well as Grantee.

D.

The franchise granted by this Ordinance is not exclusive and nothing in this Ordinance shall be construed to divest the City of its control and regulation of the rights-of-way.
