§ 105. Requirements for certificate holders.

Holders of certificates shall meet the following requirements.

A.

The holder must be at least eighteen (18) years of age if the holder is an individual.

B.

The holder must be a citizen of the United States and a resident of the state of Oklahoma or, if the holder is an alien, he must be legally residing in the United States and be authorized to engage in employment or business.

C.

If the holder is other than an individual, each individual who is an officer or partner in the business shall be considered a holder and must sign the application.

D.

The holder shall not have had a franchise, certificate, license or permit to do business as a taxicab, paratransit service or utility vehicle for hire revoked by any jurisdiction within the five (5) years immediately preceding the date of the application.

E.

The holder shall have secured and filed with the Director the location for its office within the City of Tulsa which shall be used for the maintenance of its records required under this chapter and for its lost and found.

F.

The holder of a taxicab certificate shall use taximeters in all its taxicabs, shall have a proposed color scheme and vehicle markings conforming to Section 137 of this chapter, and shall have a current and valid FCC license.

G.

The holder shall be financially responsible according to the provisions of Section 111 of this chapter.

H.

The holder shall have filed a schedule of fares with the Director according to the provisions of Section 134 of this chapter.

I.

The holder shall not have been convicted of any felony or of any crime involving prostitution or prostitution-related offenses, public lewdness, sexual offenses or controlled-substance-related offenses, unless ten (10) years shall have elapsed from the date of conviction or release from confinement, whichever is the later date.

J.

The holder of a taxicab certificate or utility vehicle for hire certificate shall have furnished evidence to the Director that at least ten (10) taxicabs or utility vehicles will be used in the service. Such evidence shall include the number of taxicabs or utility vehicles to be used, and the make, model, type and vehicle identification number of each.

K.

The holder of a paratransit certificate shall have furnished the Director the make, model, type and identification number of all vehicles to be used in the service.

L.

The holder shall have a single trade name.

M.

The holder shall have a telephone number published in a Tulsa telephone directory of general circulation.
